La mise en place d\u2019un CSE<\/strong> est obligatoire<\/strong> dans toutes les entreprises qui comptent au moins 11 salari\u00e9s<\/strong>, et ce, depuis le 1er janvier 2020. Il (Comit\u00e9 Social \u00c9conomique) remplace le CHSCT<\/strong> (Comit\u00e9 d\u2019Hygi\u00e8ne, de S\u00e9curit\u00e9 et des Conditions de Travail). La mise en place du CSE s\u2019effectue par le biais d’\u00e9lections<\/strong>. Mais avant de les r\u00e9aliser, l\u2019employeur et les organisations syndicales doivent n\u00e9gocier un protocole d\u2019accord pr\u00e9\u00e9lectoral.<\/strong> Il s\u2019agit d\u2019une \u00e9tape n\u00e9cessaire et tr\u00e8s importante pour les diff\u00e9rentes parties. <\/p>\n\n\n\n

Le protocole d\u2019accord pr\u00e9\u00e9lectoral, une \u00e9tape encadr\u00e9e pour la mise en place d\u2019un CSE<\/h2>\n\n\n\n

Il existe des formalit\u00e9s<\/strong> \u00e0 effectuer avant de proc\u00e9der \u00e0 l\u2019\u00e9lection de son CSE en entreprise. Le protocole d\u2019accord pr\u00e9\u00e9lectoral fait partie de ces formalit\u00e9s. Il s\u2019agit d\u2019un document \u00e9crit <\/strong>par les deux parties (\u00e0 savoir l\u2019employeur et les organisations syndicales). Il pr\u00e9cise l\u2019organisation des \u00e9lections<\/strong>, notamment, et sa r\u00e9daction respecte les r\u00e8gles du Code du Travail.\u00a0<\/strong><\/p>\n\n\n\n

Le protocole d\u2019accord pr\u00e9\u00e9lectoral du CSE permet d\u2019organiser et de s\u2019assurer du bon d\u00e9roulement des \u00e9lections<\/strong>. Le document, \u00e9crit, d\u00e9finit les diff\u00e9rentes r\u00e8gles concernant les \u00e9lections. \u00c9lire des membres au CSE s\u2019effectue tous les quatre ans<\/strong>. L\u2019employeur doit en informer le personnel, sauf dispositions contraires. <\/p>\n\n\n\n

Que doit contenir le protocole d\u2019accord pr\u00e9\u00e9lectoral ? Cet \u00e9crit explique l’organisation des \u00e9lections des repr\u00e9sentants du personnel au CSE selon les modalit\u00e9s pr\u00e9vues. Mais il contient aussi des mentions<\/strong> qui d\u00e9terminent les salari\u00e9s \u00e9ligibles<\/strong>, les coll\u00e8ges \u00e9lectoraux<\/strong>, le personnel<\/strong> et les si\u00e8ges au sein des coll\u00e8ges<\/strong>\u2026\u00a0<\/p>\n\n\n\n

Les coll\u00e8ges \u00e9lectoraux <\/strong>r\u00e9unissent au sein d\u2019un groupe des personnes ayant les m\u00eames fonctions<\/strong>. Selon les effectifs<\/strong> de l\u2019entreprise, un ou plusieurs coll\u00e8ges \u00e9lectoraux seront \u00e9lus. Si l\u2019effectif est inf\u00e9rieur \u00e0 25 salari\u00e9s<\/strong> \u00e0 temps plein, un coll\u00e8ge<\/strong> sera constitu\u00e9. Une entreprise qui compte plus de 25 salari\u00e9s<\/strong> disposera de deux coll\u00e8ges distincts<\/strong>. Si l\u2019entreprise emploie plus de 25 cadres<\/strong>, alors elle aura trois coll\u00e8ges \u00e9lectoraux<\/strong>.<\/p>\n\n\n\n

Modalit\u00e9s de participation aux \u00e9lections<\/h2>\n\n\n\n

Pour mettre en place le protocole d\u2019accord pr\u00e9\u00e9lectoral<\/strong>, l\u2019employeur doit convier aux n\u00e9gociations plusieurs acteurs<\/strong>. Par exemple, les organisations syndicales<\/strong> respectant les valeurs r\u00e9publicaines et d\u2019ind\u00e9pendance. Elles doivent \u00eatre cr\u00e9\u00e9es depuis au moins 2 ans. Mais aussi les syndicats affili\u00e9s \u00e0 une organisation syndicale<\/strong> repr\u00e9sentative<\/strong> au niveau national<\/strong> et interprofessionnel<\/strong> comme la CFDT, CGT, FO,.. Les organisations syndicales <\/strong>sont aussi concern\u00e9es, reconnues repr\u00e9sentatives dans l\u2019entreprise ou l\u2019\u00e9tablissement. Enfin, les syndicats<\/strong> ayant constitu\u00e9 une section syndicale dans l\u2019entreprise ou l\u2019\u00e9tablissement.<\/p>\n\n\n\n

Tous les salari\u00e9s de l\u2019entreprise ne peuvent pas voter aux \u00e9lections du CSE. En effet, ils doivent remplir certaines conditions. Il doivent notamment \u00eatre \u00e2g\u00e9s d\u2019au moins 16 ans<\/strong> r\u00e9volus, et exercer depuis au moins 3 mois dans l\u2019entreprise<\/strong>. De plus, les salari\u00e9s candidats ne doivent pas faire l\u2019objet d\u2019interdiction<\/strong>, d\u2019une incapacit\u00e9<\/strong> ou d\u2019une d\u00e9ch\u00e9ance<\/strong> en ce qui concerne ses droits civiques. <\/p>\n\n\n\n

Les conditions pour \u00eatre \u00e9lu au CSE ne sont pas les m\u00eames que pour \u00eatre en capacit\u00e9 de voter. Pour se pr\u00e9senter aux \u00e9lections<\/strong>, le salari\u00e9 doit \u00eatre \u00e2g\u00e9 d\u2019au moins 18 ans<\/strong>, et avoir une anciennet\u00e9 de 1 an minimum dans l\u2019entreprise<\/strong>. Cependant, les conjoints, les partenaires d\u2019un PACS, les concubins ou encore les ascendants et descendants de l\u2019employeur ne peuvent se pr\u00e9senter \u00e0 une telle \u00e9lection. <\/p>\n\n\n\n
